Dear All
one of my friend got pregnant and she is working with a rubber industry but she is on third party payroll.
she didn't have any kind of medical insurance from her employer not got ESIC because her gross is more then 25000
and didn't have any slab for medical in her salary structure
problem is this in her salary structure 80% amount she gets as special allowance
basic is not more then 5000 and HRA 2500
can any body suggest what should be her maternity bonus she will get if she claims maternity leave........from her employers

Maternity Bonus as per Maternity Benefit Act is the same Rs 3500 (at present) for all employees irrespective of salary.
Your friend shall get 84 days leave with full salary from her actual employer (who will be the third party under whose pay roll she is working for the company) It is quite natural that employers would prefer to reduce the basic salary(statutory salary) to the minimum so that his contributions towards EPF, Gratuity, Bonus etc shall be reduced. However, putting 80% as special allowance itself is an indication that the employer has ability to pay "so as to get manpower" but is not willing to pay statutory contributions that he himself should bear. Therefore, if the salary of the employee before proceeding for maternity leave is Rs 25000, that will be the salary payable during maternity leave days.
