Dear Sir,
we are having 50 Person Diploma Trainees Category, on 2010 one of our Diploma Trainee got injured in his right hand finger tip got cut, immediately we will give treatment at Stanley Govt Hospital and Filing Accident report to Inspector of Factories & ESI Inspection also Complete but still they didnt get any benefit from ESI,
But the Diploma Trainee irregular to the company , we will take action or any punishment time they will ask for Compensation for injury.
Kindly advise me to remove this person without legal problem.

Case 1: Reg ESIC benefit not got
check with him whether he got admitted under the ESIC hospital if not did he consult any ESIC panel doc b4 taking admission in private hospital
if he has not done the above case the ESIC will try to forfeit his full amount or may be make interim payment on case to case basis
Case 2 : He is irregular
You just cannot remove person w/o following proper intimation process
If there is regular absent ism have one to one talks to him as to why this is happening issues him a memo or show cause notice
if same think continuous issues him a stern warning letter
once u are done with the above process you have the right to terminate him on regular absenteeism
