The back wages need to be computed in terms of the court's order. If the order specifies the allownces to be included or to be exluded in computing back wages, it needs to be computed in terms of such order.If the court order merely directs the employer to pay back wages for the period of unemployment, it plainly means, he should have been paid all those allowances, which he would have earned, had he been inservice.Since you have not specified the reason as to how the employer paid the employee only Rs.6000/-instead of Rs.85000/- it will be difficult to comment on it.
