Dear friends,
Maternity benefit bonus payable under Section 8 of Maternity Benefit Act 1961 has been increased from Rs.2,500/- to Rs.3,500/-. Copy of notification dated 19.12.2011 in this regard is attached for your information.

Sir, Pls let me know regarding maternity bonus. Is this paid for an Employee who is under ESI scheme during maternity holidays. Can hospital bills be claimed through ESI. Rima

1. Explain the Maternity Benefits Bonus
2. If any one availing the facilities through ESI . Whether it is applicable.
3. Any minimum days of working for applying the above and calculation

Dear friends,
I am attaching copy of Maternity Benefit Act 1961 for your ready reference.
Maternity Benefit Act is not applicable in factories or establishments covered under ESI Act. You may refer to Section 2(2), 5A and 5B of attached Act.
As regards medical bonus of Rs.3,500/-, same is available under Section 8 of the Act. It is available only to woman entitled to benefit under this Act.

If an Insured woman or wife of IP not availed ESI felicities for delivery, then Maternity medical bonus eligible as above mentioned persons.

If an organization is covered under ESI Act, then Maternity Benefit Act is not applicable there.
Not availing a ESI benefit will not make an employee eligible for benefits under MB Act.
