my service continously break 8 years in every 11 month.
now from1/6/2009 i m getting sixth pay. iwant to know can i get graduty ?
can i elligibal for employee pension .(my pf no. is gj/13328/308
give the example of graduty and e.p.scheme

For gratuity one should be in a employment engagement for continuous 5, no break up in continuous 5years , holidays , wekly off , pl, el will be included in the continuous service , also any gap in service due to employers will, example lockouts , strikes, where the employee is not involved , and which happened due to the pudence of the employer will also be calculated..but where the employee is involved due to his misconduct ,indisciplinary actions, damages etc that will be considered as break..
Now in the 5th year 240 days are considerd as 1 complete year also..judgement by madras court.
last month's basic+da *15 *service years/26

You will be eligible for pension after completion of 9.5 years service in PF. Continuos service is not mandatory to get pension. Abbas.P.S
