Dear Senior
i have recently joined a IT company , here we have 36 employees, in feb 2012 we have 20 employees all r getting more than 16000 salary, but due to some projects we hire 16 more employee in march 2012 , all are junior level employee getting less than 15000 salary.
our company was established in 2008, but as all emp are exempted from ESi we have not applied for ESi number.
now we want to register in ESI coverage.
what is the procedure? do we have to pay any penalty for late registration ? if yes how much penalty will be charged?

you ay go for esi registration. Better take support of consultant for this job. Also, strategically & tactfully, you should have outsourced this junior manpower to a third party vendor.
Quality would not have been compromised, you recuit, interview candidates but put them on a vendor or another company payroll, so that pf, esi liability is theres...... Anyhow still not very late, its only march 2012.... Still you may adopt the model after carefull discussion with seniors & employees

As per the new notification by the ESI department now irrespective of salaries if the organization cross 10 employees w.e.f from 16th March 2011 onwards it is mandatory to obtain the registration;
Hence your date of coverage starts from 16th March 2011 onwards;the department will valid the no of days delay in payment and based on it the interest and penalty will be levied;
First obtain your registration and make the remittance then file your half yearly returns after which the department will send you the demand for the interest and penalty, in a tables.

u had given me a new idea, actually i had hired a consultant for this job, he had changed all employees joining date, he is going to show that we r 9 people till feb 2012.& from march 2012 we r 36 & liable for ESI.
but this will create problem for taxation as 20 emp r out of coverage getting more salaries ,even tax is deduct able. we have to give them form no it may create some problem in future.
my question is till Feb 2012 we have 20 emp having more than 16000 salary means not under coverage of ESI.
so their should be not penalty for them, no previous return for them .
from March 2012 we hire 16 junior emp less than 15000 salary , & from march we r applying for EsI registration . SO we have to pay only for 16 emp return.
