Activity of trade union leader - is it legally acceptable?
Dear seniors i have two queries my organisation is a manufacturing unit and has a registered trade union of regular workers. a is union leader excuses from work in organisation? in our organisation all the office bearers including secretary and president of union work in the general shift. but all the time the secretary and president simply roams here and there without doing their allotted work. also they are not ready to do their union activities during off time. in our general shift the shift start at morning 6 a.m. to 9 a.m. 9.30 a.m. to 11.00 a.m. and again from 2.00 p.m. to 5.00 p.m. so they get a long break which is from 11.00 a.m. to 2.00 p.m. but no intention to do the union activities during that time. is there any rules to imposed on them to do their daily allotted work in the organisation. and b its came to know that newly they have union president & secretary amended their byelaw by their own and put a provision that if they will not elected this time in the election which will be held on june 2015 then they will automatically get the position of their executive office bearer among 7 seven active members. is it possible or can they amend their byelaw in this way? please share your valuable views on these two queries. thanks.
Can trade union get dissolved if they lose minimum 10% of their total workmen membership
Dear seniors please help and advise me on it in my organisation 23 executive members has resigned the membership from total strength of 27 executives members of the workers union. also out of 650 general members of earlier union 625 has resigned and form a new union. now the earlier union registered trade union is unable to keep the minimum strength of 10 of total workmen which is required to form a union. the new union submitted a petition to the management that to dissolve the earlier union immediately as they are not carrying minimum standard of forming union. so can management dissolve the earlier union as they are only with 4 of their members and rest joined new union which is under process of their registration and applied to labour commissioner office for registration. the management also has given the recognition to the new union and initiated to the competent authority accordingly. now can management ask the earlier union in written to vacate the office management property which was occupied by them and to handover it to the new union please help me on this. your necessary advise and support will help me a lot in this regard. thanking you.
Valid union - as per trade union act, 1926 union should have minimum 7 people?
I m working with one of the pharmaceutical company; here we have union of "akhil bhartiya chhava sangh"; at the time of formation of the union the union had only 7 employees. after formation of the union in few months one of the union employee had died. all employees are on the company roll permanent employees; now the situation is only 6 are there.. so my question is is this because as per trade union act 1926 union should have minimum 7 people... so please clear my doubt.
