Hello,
One of the employees of my company has met with an accident. I want to know, is the company liable to pay the salary for the entire month? to add on, he met with an accident on a weekday, on which he had left the office on half day (arnd 2 p.m.), and had the accident in the evening while reaching home. In such a case, is the company liable to pay the salary for the month. Please suggest.

Hi Rupali,
Its a Management's decision. The organisation can pay for the Sick leave as well as the medication (partial/ complete) incase of serious injuries.
It can be a combination of both or either of it.

there was a simliar case involving a BEST employee. he got injured while returning home..
under workmen compensation act, employee leaving/ reaching back home comes udner the purview of "notional extension of time n space" and so entitled for compensation.
in May another ruling from Haryana came up.
as per this ruling, if an employee gets injured/ permannetl disabled then work out the following before asking him to leave:
a) alternative employment
b) retirement benefits
in case of total inability of the company to provide alternative employement then definitely more compensation

Dear Rupali,
Your employee met an accident after comleting half day duty returning to home. However, company need not pay full month salary for his rest period neither they are liable to pay any accident compensation. But it depends on co. discreation to pay full salary / compensation.
If your employer opened any group mediclaim policy from Insureance co., then he can apply for reimbursement of expenses subject to limit.
Presently in Maharashtra state, notional extension was abolished so there was no question to pay full salary. You pl. check this rule applicability in the W.C. Act.

an employee had an accident following which the effect was total disablement, now this accident happened when the said employee was on annual vacation.
