All the Establishment except Factory / Company will be covered under S & E act and there is exemption for certain shops & service industry which would be brief in the S & E act of respective state.

Yes you must register your company under S& E Act. Doesn't mater of No employees if there is 1 employee also you have to register.There are fee structure based on employee headcount you have to pay for it to govt.
