As far as my concern ,there is no pf contribution made on Conveyance allowance.PF is deducting on Basic +DA

Hi,
It is true that basic wage should not be less than minimum wages, but gross salary is higher then 50%-60% should be kept in basic, 40% of basic should be in HRA , not more than Rs. 800/- will be kept in conveyence allowance.not more than Rs. 1250/- will be kept in medical allowance rest all be kept in other allowance. Medical allowance paid only to them who are not benefitted with esic scheme. But mind it basic wage should not be less than minimum wage of the state.

Treating the Conveyance as part of Basic is not correct. I feel you can challenge in the court of law citing Govt. Pay Commission Report were in Conveyance Allowance is independant to Basic and no way related to it. The best way is to bring stay on the EPF contention immediately from court of law and then seek legal course on the issue.

There is no law stipulating that basic wages shall not be less than the minimum wages. The Courts in the AirFreight case and the Hiralal 's case which I have referred to in my earlier reply, have abunduntly recognised the employer's descretion to fix the quantum of basic wages and the quantum of other allowances and did not consider it as violation of the minimum wages Act even though the employer pays lesser basic or dearness allowance as part of wages than what was notified as basic and D.A by the Govt. so long as the total wages paid by them is eaqual or more than the minimum wages notified by the Govt.
