If the Factory is under construction and it is within the running factory premises, then the factory inspector is having the power to enquire the accident and instruct the Contractor to take necessary remedial action through Principal Employer. If the premises under construction and the manufacturing process is not commenced, then the Factory Inspector is having the power to enquire the accident as he is the competent person appointed by BOCW Act of the concerned state Government.
Hope that the penalty cannot be imposed on the contractor or principal employer, but he can instruct the contractor to pay the Workmen Compensation amount, Leave pay, Gratuity amount and in addition he can pass order to pay ex-gratia to the deceased workman.
