Hi, I wanted to know If we can place a hold on an employee’s salary due to XYZ reasons.Is it legally permitted?

one of the reason is if the management comes to know that the employee is not going to give the resignation and will just abscond after getting the salary.
Another reason is if the employee is not regular and has been absent and has taken uninformed leaves.

The 1st reason is illussionary and you can’t hold based on some imaginations. 2nd comes under LOP or availing from leave. however, unauthorised leave salary hold may be permissible. Pon

As long as an employee reports to work, salary cannot be held back.
In cases of job abandonment, No Call No Show guidelines can be followed. Even in cases where you are expecting a resignation, the employee has to be paid till his last working day.

You being a full member, I can merely express my surprise on the nature of your question, particularly when you state XYZ reason! Why would you like to stop salary of an employee if he has discharged his duty?
Do you think an employee is a bonded labour of the management and should remain at the mercy of his employer whether that pays or not the compensation for his work?

The reason i wrote I started a thread is to gain knowledge and to know what happens if this area persists.its not necessary i am being a part of such an activity or its my feeling.
It merely a question .

Dear Sjivani,
The reason must be specific. Quoting "XYZ" would mean any frivolous reason on account of which the salary is sought to be put on hold. So, if you desired to get knowledge you would better have quoted certain reasons, which you could think that the management often thinks to withhold the salary of employees.

Not sure why you would want to hold back the Salary unless the incumbent has not fulfilled his duties as per the Company's guidelines. If he is not handing over Company property - then this is another issue altogether.
As Mr Dingra pointed out - if you can share with us any specific reason you have in mind then I am positive the Forum would guide you by providing you with appropriate options/course of actions.

Dear All,
Holding Salary of employee is unethical in nature . This will lead to
1.Hamper reputation of the company.
2.It will be treated as harassment
3.Case can be filed by the employee as a criminal offense.
