Dear Aarti,
You need to be clear on the question first , There is no importanse of 15000/-gross in EPF. PF is based on basic not gross. PF wage celing is 6500/- basic, means 780/- after that employer can get exemption from PF department.
15000/- is the wage celing of ESI.

Praful,
In my last company where i was working PF & ESIC used to be deducted every month but the company was not registered under PF & ESIC and they never opened PF account of any employee. I know this since i was working in HR dept. When any employee used to ask for PF account number my manager was always asking me to give the answer that it is in process. But it never happened. Now the company has got shut down.
What can we do to get the amount that was deducted from our salary..

Dear Aarti,
PF deduction criteria 1) The employer's staff strength should be above 20 nos. 2) For such companies PF deduction is compulsory.
3) PF is deducted on basic+DA. 4) Employer's liability is limited to only 12 per cent of Rs. 6500/-. 5) Even if the basic+da is above 6500/- employees pf can be deducted at the total amount. They can opt for deduction up to 20 per cent of their basic+d a, even if the total amount is above Rs. 6500/-.
Your assumption that employees whose basic+d a is more than 6,500/- are exempted from PF deduction is not correct.

Dear Aarti,
The PF ceiling is of Rs. 6500/- but, if you deduct PF from first day of the job on Rs 6500/- then it can be continued.
But if you deduct pf on 15000/- salary then you have to continue to deduct pf on 15000/-.
For pension scheme you may split salary of Rs 6500/- as pensionable salary and rest to contribute to PF.

Dear Aaeti,

In line with topic Please not fallowing rules while calculation the Providet Fund calculations.

Biasc +D.A / VDA /Special Allowance if it exceeds Rs.6500/- it depends on the management part wether to pay the higher employers contribution or not but at the same time it binding on the employeer to pay the eployers contribution up to to or within the limit.

If we consider that Mr. X is your employee and drawing Basic Salary of Rs.10000/- P.M

In case of sealing the Salary for calculation is considered Rs.6500/- and employees contribution is 12% and Employer 12% except Admin Charges.

Employee contribution of 12% will directly goes to Employee Provident Fund and Employers contribution among the 12%, 3.67% will go to Provident Fund and 8.33% will go to Employee Penssion Scheme.

If employer are will to contribute on actuals without considering the sealing then.

Basic + D.A is 10000/-

Employee contribution of Rs.1200/- i.e.@12% on Basic +D.A will go to Provident Fund and Employer`s Contribution 9459 will go to provident fund and Rs.541 will go to EPS because Employee Pension scheme have limit of contibution maximum 541 and the remained balance will got employee provident fund.

Dear Aarti,
In respect of establishments employing 20 or more persons and engaged in industry notified under Section 6 of Act ( other than the Establishments. declared as sick ) 12% of the basic pay DA , Cash value of food concession and retaining allowance , if any, subject to a maximum of Rs.6500/- per month.
It's binding on employer that he has to contribute the PF for basic Rs 6500 irrespective of the higher basic than Rs 6500. PF contribution on excess basic may 0r may not be contributed to PF account based on employer's policy in this regards.
