i was on leave for 5 days. i had informed 15 days before to my manager that i have some personal family issue so i need leaves.
in response i got "Unless the reason is clearly shared with manager and if i feel that you genuinely need to be on leave during that duration, only then leaves will be approved. As of now, they are unapproved."
so my question is, can manager ask personal issues forcefully?
i was on leave with disapproval.then i got the response "This indiscipline is completely not acceptable. It is no longer a performance issue but general office etiquette and discipline.I no longer see you a fit for my team and a fit within company. Consider this as your 1 month notice period effective from today."
please help me, what should i do in this case?

Leave is not the right of the employee, it is the proragative of the management. It is the responsibility of the employee to obtain the sanction of leave before proceeding on leave. When you got the information you would have told them about your personal problem and would have obtained the permission and with out obtaining permission proceeding on leave is a misconduct.
I believe better you meet the concerned authority, appraise the situation and try to resolve the issue instead of going for a confrontation. Eventhough it is not correct on your management part to refuse your leave but looking at the entire episode ultimately the non-compliance will be at your side.

Sure, he has right to take leave as all the acts are having leave reules. what did you join ? have you applied EL or any other leave ?
Gave you sent a written communication in this regard ? Do you have any other issue with your Boss ? When leave was rejected, then you took leave ? You could have fought back and got the sanction.
Now send a written communication with a detailed reasons for the leave taken and apolozise to him for availed the leave with out approval. Ask him to give you a chance for one time to prove yourself to fit in to the job ? Give him written assurance about what are you going to contribute to the growth of the company in next 2-3 months.

i can not tell my company name. its a s/w development company.i am telling to some lines of mail on my leaves.
me:"I need 5 days leave in next month 10th Oct to 14 Oct."
manager:"Can't be approved without very strong reason."
me:"Some personal family related work.
me:"According to leaves rules I am Applying before 15 days. So I do not thing I need to describe every things."
manager:"When ever you apply for leave you have to provide a reason, whether you are applying one day before or one month before."
manager:"You can discuss leaves policy with HR. I do not want to discuss here. Unless the reason is clearly shared with manager and if i feel that you genuienly need to be on leave during that duration, only then leaves will be approved. As of now, they are unapproved."

hI Chinthan,
If you are taking leave(EL) and you are eligible for that means you can go ahead and take the leave.If not then you can explain your situation but dont want to explain your personal problems to the manager.It is no where written that the personal problems should be briefed to your boss if it is pertaining to apply leave.
Also,Granting of leave also depends on the employees regularity to the company.If you often take leave then managers will be jitterish/reluctant to give you off,they feel that you are not dedicated to the job and not responsible enough...So make sure before you go for a confrontation.
Talk to your manager in smoother way with the presence of HR person to resolve the issue.No company will terminate you for taking 5 days leave unless or until there are other factors affecting it.

Hi,
As stated above, it is correct that Leave is not the right of the employee, it is the proragative of the management. Also, be careful, if u proceed on leave without its sanction on the same date for which u applied leave, it will be viewed as serious misconduct and u may be penalised by your organisation.

yes, i have 10(EL) in my account for this year.
last mail from manager was

Chintan I strongly feel you should ask for one more chance and apologies. Explain him whatever your problem is.

As per Ajeet Kumar & kamesh first know howto spell "Prerogative".It's not "Proragative". And as per your views we are not in a king and slave community and with out the workforce no company will stand still.And as per your views you mean to say that if only company tells to take a leave then we should.Come out of your ignorance. And you say that the personel reasons should be mentioned to managers you do the same or what. It's the right of the employee to take leave. What ever may be the reason. And i do not support frequent absentisam.
