Before last 02 months of maternity leave employer has sent "notice of termination" & asked that they are giving two months time as notice period. the reason for termination they wrote in an email is "termination of designation held" is it legal? what actions should be taken? what are the options available? whom to approach first factory inspector or should consult lawyer? thanks

Good noon to all i worked in an organisation for 4 months and took maternity leave for 5 months. as am outsourced by my company they reject my maeternity benefits and deny my rejoining. i approached my consultancy and company for joining letter experience letter and termination letter stating but still both of them didn t respond anything. what will i do now? i need to register complaint to labour court. still i didn t have joining letter and i didn t sign any contract. kindly help me in this issue .

Dear all one of our lady employee has applied for maternity leave for 3 months and her leave has granted by the management. as per our hr practice employees are entitled to get 32 days leave annually is she supposed to get this leave separately or it can be included with her maternity leave. regards. debasish chakraborty

Dear seniors need your valuable advice one of our employee is on maternity leave we have given her the maternity benefits under esic we have appointed a new person in her absence on contract. now we want to appoint the new person on permanent basis in place of the old employee who is on maternity leave. i want to know if it is legally allowed if we terminate the services of the lady once she joins back office after her maternity leave by giving her 30 days notice / salary in lieu of notice.

My daughterinlaw is working in a private sector since last 2 years. she is not covered under during pregnancy she had taken the maternity leave from 1st september 2017 once she had completed her 7th month of pregnancy. on 17th october she had delivered a baby girl and till today she is on her maternity leave. today her office has informed her that as per their policy they will pay her 84 days salary as maternity leave and they will process her for full and final and terminate her service without giving any other reason. my query : 1 what is the latest provision on maternity leave. 2 whether she is eligible for the maternity leave for 26 weeks as per the new amendment. 3 whether her termination from service can be treated as harassment to women employee on account of her pregnancy . 4 whether i have to file a suit with the commissioner of labour? dear expert please help. urgent please. thanks and regards deepak
