Hi Everyone,
If any employee who crosses the age limit of 58yrs then does he have an option of contibuting towards PF or not?
Then how about the ESI, if any employee who crosses the age limit of 58yrs then the ESIC will allow us to contribute towards ESIC or not?
Please suggest me ASAP.

Hi Vinay,
There is no age limit for ESIC Contributions.
But for PF Contributions, If an employee cross 58 Yrs of age his Pension fund will also be remited in the Provident funds account itself. i.e., Employee PF - 12%, Employer PF = (EPF-3.67% + FPF-8.33%). This 8.33% amount must be remitted in Provident funds itself.
Note : 1. if an employee is already a Pensioner from EPFO he will be eligible for PF deductions,
2. if we appoint an employee newly with the age of more than 58 Yrs he may be kept as a Trainee or Paid Consultant for which PF will not be Applicable.

Now that particular employee is asking to terminate his PF A/c since he crosses 58yrs & he wanted to apply PF withdrawal of his a/c besides which he even works for our company. So, can we allow him for PF withdrawal.

after 58years also u can continue P.F & E.SI
but there is one clause in P.F act after 58 years of age you need not to pay penshon fund(8.33%)
Below i given example
Age fator Employee Employer
Basi+D.A 12% Diff amount 8.33%
Below 58 years 6500 780 239 541
After 58 years 6500 780 780 0
As per my knowledge i given above example if any discrepancy please post.

Dear All,
He/she may contribute to EPF and ESI but not to EPS at the age of 58 years because he/she has already attended the age to receive pension.
If his/her Basic salary more than Rs.6,500/- then he/she may not contribute on mutual consent of management and employee and same to be communicated to your EPFO.
His/her past contribution can be withdrawal and if he/she has the scheme certificate then can deposit in the EPFO to receive pension amount.

I have a small query related to this:
if a n employee crosses 58 years and not completed 10 years contribution , will that employee can stop payment to pension fund in lieu of crossing pensionable age.

ESI contribution should be paid till an employee is in service. There is no age limit for ESI contribution as ESI rule is silent on the age of an employee. regards, Kamal
Dear Mr. Kamal
1.I agree with you that there is no age limit for contribution till employee is in service but it is subject to coverage of salary Limit for ESI i.e. 15000/-p.m.
2. The various benefits under ESI will be available within contribution/benefits guidelines under the act till you are in service only.
3. Even after retirement, by paying lumpsum token contribution(as per ESI), only medical benifts will be made available/continue, provided at the time of retirement you were covered under ESI scheme & paying contributions.

Small clarification on PF Pension.
After completion of 58 Years age, and even the employee is continuing the service, Pension amount need not be paid. But can he get Pension amount monthly, once he crosses 58 years.
Also clarify when he can get certificate.
Request u pl.clarify.
