Hi! Everyone, Could u plz suggest me if a manager suddenly announces that Apprasial Period is increased from 6 months to 1 year and in second case if a manager says that notice period of leaving is increased to 1 month to 3 month .i.e. A Employee has to give prior 3 month notice instead of 1month before leaving. In that case how we can convience the employees to adapt these situtaion?

If it is Lala's Dukan then anything could happen!!!
If it is company then all the abovesaid matter should be In Written with acknowledgement from all the employees!!!

For Staff & Managerial position if the party does not consent ( Preferrably in written ) to Changes in contract then the Changes are not enforcable to such party.

9A. Notice of change


No, employer, who proposes to effect any change in the conditions of service applicable to any workman in respect of any matter specified in the Fourth Schedule, shall effect such change, -

(a) Without giving to the workmen likely to be affected by such change a notice in the prescribed manner of the nature of the change proposed to be effected; or

(b) Within twenty-one days of giving such notice

Provided that no notice shall be required for effecting any such change.

(a) Where the change is effected in pursuance of any 1[settlement or award]; or

(b) Where the workmen likely to be affected by the change are persons to whom the Fundamental and Supplementary Rules, Civil Services (Classification, Control and Appeal) Rules, Civil Services (Temporary Service) Rules, Revised Leave Rules, Civil Service Regulations, Civilians in Defence Services (Classification, Control and Appeal) Rules or the Indian Railway Establishment Code or any other rules or regulations that may be notified in this behalf by the appropriate Government in the Official Gazette, apply

Hi Manpreet,

Mr. Prashant Ingawale has very well laid out the procedure that is required to be followed by an employer regarding the notice of change. It will definitely help you better undertsand the criteria and develop your answer. In addition to this, I also want to add that as far as convincing employees about the proposed increase in the appraisal period is concerned, they can be assured monthly or bi-monthly meetings with their immediate superior (boss or supervisor or manager) so that they keep getting informal and periodic review of their performance and thus, make imporvements accordingly. These informal meetings can also serve as a platform for employees to provide their feedback about company operations and resources that are needed to perform their respective jobs better.

Often times, companies conduct performance reviews annually to save time and money on the entire procedure, but such short-periodic meetings not only make the employees feel involved, but also help enhance subordinate-superior relationships.

Hope this helps. Also, when confronted with such questions, you can visualize yourself as an employee and ty to figure out what would satisfy you if you were one of those affected employees....
