Dear Seniors and friends,
I need your help. I am working with a manufacturing company and having a licence of 500 workers. But 295 workers and 10 guards are working in our factory. Guards are on contract basis.
Tell me, whether we would require to have a welfare officer and if required, what would be his qualification and salary as well as duties and responsibilities. And do we need to a welfare committee.

Section 49 of Factories Act, 1948 requires appointment of Welfare Officer(s) whereinfive hundred or more workers are ordinarily employed by the occupier. Sec. 49 may be read as under.
49. Welfare officers. — (1) in every factory wherein five hundred or more workers are ordinarily employed the occupier shall employ in the factory such number of welfare officers as may be prescribed.
(2) The State Government may prescribe the duties, qualifications and conditions of service of officers employed under sub-section (1).
After going through this section it is clear that we are to appoint W O only when we ordinarily employ 500 or more workers but in your case you have only taken the factory licence for 500 workers & have employed only 305 workmen including contract workers in your factory & therefore in my opinion until you employ 500 or more workers you are not required to appoint W O.
I have not heard of welfare committee. Section 3 of Industrial Disputes Act, 1947 says us to constitute works committee wherein 100 or workmen are employed.

Dear Sir ,
i am working on payrol of adeecco flexione india , they have appointed me for one of the leading telecom gaint , i am working in maharashtra state , the problem is clint of adecco has not paid the petrol allowances from last 1 year , is there any law which can ptotect us from loosing the money , whenever he ask our managers they say if u ask it again we will terminate you . their intension is not to pay us . please guide me as i have borrowed money from friends & family on the beleive that whenever company pays me i will return but now situation is different . please help
( allowances has not mentioned on our appointment letter but we do have a proof that we are entitled for the same .)
