Accumulating weekly off
In my factory union on behalf of majority of workmen is requesting us for running factory continuously for 20 days so that they could accumulate their weekly off and avail weekly off alongwith forthcoming diwali holidays. for the same they are also ready to forward their written request to mgmt. as well as to the labour deptt. we know that as per fa48 we have to give weekly off with in 10 days. for checking absenteeism after the festival mgmt. too is showing interest for clubbing weekly offs with diwali holidays. my question is that can we do this ? if yes under which rule of the relevant act and to which enforcement authority we have to inform legal experts kindly advise. regards
Maternity benefit act - treatment of leave with wages and weekly offs in computing 80 days actually worked before edd
Dear all section 52 of maternity benefit act provides for counting of holidays declared under any law time being in force as holidays with wages for computing 80 days actually worked before preceding edd. said provision does not specify about treatment of weekly offs and leave with wages. can leave with wages and weekly offs with wages be said to be "declared holidays under law" or connotation of "with wages" is the guiding principle irrespective of it being a holiday leave or weekly off? please guide. regards manish
Treatment of weekly off/closed holidays during joining time on transfer
If an employee is transferred & relieved on saturday. he joined on monday. sunday was his weekly off. transferee unit claims that they have relieved him on saturday therefore they cannot indicate his weekly off sunday in their attendance. the office he joined on monday claims that since he joined on monday they cannot mark on his attendence as sunday weekly off. what would be the fate of his weekly off. where joining time say 10 days allowed. what happens to his weekly offs guezetted holidays falling during his joining period. regards

Dear seniors as per section 52 weekly holidays suppose weekly off is on thursday employee is absent/ leave from work on friday saturday sunday monday if employee joins duty on tuesday & also worked on wednesday then is he eligible to enjoy weekly holiday on thursay? though as per section 53 he has not worked for six days? thanks in advance.
