Earned leave encashment
Dear friends though this earned leave encashment is being discussed at different times and forums still there is some difference of opinion. section 79 of the factories act 1948 says that every employee who works for 240 days in the previous year is entitled to earned leave 1 leave per 20 days of working. when the worker is discharged or dismissed or quits employment the unused earned leave at his credit has to be paid. a worker is entitled to accumulate upto 30 days of earned leave and over and above 30 days will lapse. suppose a person who is having earned leave at his credit more than allowable 30 days and has not taken leave nor organisation didnot allow him to take leave then the additional leave is to be compensated or encashed? is this the company policy or is it mandatory? this is not very clear in the factories act. i invite our learned friends to post their views along with mandatory laws/rules if any for the benefit of hr people. srinaren

Dear all kindly let me know "what is mean by earned leave ?" my previous employer was considering working day as earned leave but current employer doesn t calculate it that way. if leave is taken along with holidays then they consider those days as leave which i think shouldn t be done. is there any legal document to support the statement of earned leave against working day only ? if holiday is also considered as leave then what about the compensation of lapsed holidays ? kindly let me know more about this according to good industry practice what is correct. regards aparna
Is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?
Hi please tell me how do we calculate leave encashment. for eg: monthly gross salary is rs.10000/ out of which basic5000 hra2500 medical1250 conv800 misc allw450 then how much would be leave encashment of 5 days?? is the leave encashment calculated on last earned basic or it is calculated on the basic for the period during which the leave was earned?
Clarification on earned leave as per factories' act
Dear all request for clarification on the following 1. as per factories act whether completion of 240 man days is compulsory to become eligible for earned leave? 2. whether the paid leave availed in the previous year has to be taken into account only for the purpose of 240 days completion or to calculate the quantum of leave for present year? 3. whether an employee who is working for more than 2 years is eligible for leave if his total mandays fall less than 240 days in a previous calendar year? 4. whether the employee joined in the middle of the previous calendar year say in october is eligible for leave in succeeding calendar year? 5. whether leave encashment has to be made for an employee who has joined and worked only for 5 to 6 months and resigns? 6. it is not mentioned either in the factories' act or in any other acts as regard to calculation of leave encashment. some of the views that in case of monthly rated employees to arrive at daily rate monthly rate should be divided by 30 days. some others view that monthly rate should be divided by 26 days. request someone to highlight the correct and justifiable procedure.
