Dear kamal, Is this form applicable for all states.and can you please suggest upto what duration after treatment this form can be used. Regards, Smriti

@Smiriti, Its applicable to all ESI covered areas in the country. Only the first page , which is in marathi language is for Maharashtra only.
As told by a very senior ESI (H.O) official, one ESI hospital in every city has been authorized to accept such forms.

when an employee avails leave on esi certificate, he gets both the benefits as half salary and leave from company with full pay on debiting his SL on his leave account. what is the right method

Its always better to go through proper channel, like getting the recommendation of ESI medical officer.
But in case of emergency where you are not able to visit a ESI doctor/hospital for whatsoever reasons, you can request the reimbursement of medical expenses from ESI dept.

No It is not permissible to claim both leave salary from the ESI Dept as well as sick leave salary from the Employer for the same period. It is an offence punishable under section 84 of the ESI Act. The right method is either to claim from the ESI or from your Employer. Any one only .You should not do for the both.

This is not I sought information. How one employee can avail 50% wage on ESI and avail the company Sick Leave with full wages. The company cannot say no for leave as he was sick and submitting his medical certificate. They cannot avoid adjusting the leave on his credit, else he would have one day extra on his leave account.
kindly send me the gezzete which publish this information that ESI can re-imburse without referring by ESI. Because one of our employee took treatment by private hospital after circulation my mail about this information. now ESI refuse to re-imburse him. He is bleaming me. Plz help me.
