  • Simple and straight forward way of making use of available legislation is to lodge a written complaint with concerned labor inspector / shop act inspector under shops and establishment act and pursue and force him to take appropriate action against the employer.

I am not advocating for compensation for the extra hours put in as pointed out by Mr.mpadhu. The best situation would be when the working hours are clearly defined as per the law and rules, but it is a fact that there is no escape at present for employees from putting in extra hours at the cost of their social life, so considering the situation why not at least compensate them handsomely?
Also what is suggested by Mr.V.Harikrishanan is very relevant. There is no will to implement the law and the employees are at the receiving end because they do not have the strength, courage and the determination and an union to fight it out.An individual who raises his voice is simply thrown out.Law enforcing authorities retired and serving should help them in this cause.

Dear Mpadhu,
One should go to the history of enaction of trade union Act. Similar exploitations were there but our predecessors fought and got the result. Here at least the retired or who have left organization can take the lead to recover dues of overtime. Then wide publicity of negative attitude of mgt can mitigate exploitation. The laws are already there. For example. Shops and establishment Acts, ID Act which have to read together protect the interests of workman. What is there for shying if one is covered under workman. Once one is covered under ID Act and 240 days in a year have passed on duty, then it is easier to obtain divorce than to get rid of a workman.So it is only lack of knowledge is resulting the problem.
