Dear Dhiraj.karn,

First of all, let me welcome you to this knowledge-sharing forum, CiteHR. Please go through https://www.citehr.com/231-rules-reg...#axzz1W7D5QwVw and https://www.citehr.com/118961-welcom...#axzz1VTFxgVcY.

Please understand that the Factories Act, 1948, is made for factories involved in the manufacturing process, and the BOCW Act, 1996, is made for construction and building work.

If the Factories Act is applicable, then the BOCW will not be applicable, and if the BOCW Act is applicable, then the Factories Act and Mines Act will not be applicable to them.

As a matter of fact, the BOCW Act is a newer act, for which the responsibility of inspection has been handed over to the Factories Inspector, who is also the Registering Authority for BOCW Registration. Since the Factories Act is older and the BOCW Act is new, the factories' inspector will always deal with it as a factories inspector and not as a BOCW inspector.

I hope I have cleared your doubt. If you have any further queries, please do not hesitate to ask.

All the best and happy learning.
