The settlement with our Union was valid upto 31st March 2011 & negotiations for Settlement for a further period of 3 years are in progress. As a result of the settlement which would be entered benefits will have to be given from 1st April 2011. Assuming the settlement is reached in August 2011. is it legally necessary to pay Provident Fund & ESIC for the Benefit given in the form of Ex Gratia Payment for 04 months from 1st April 2011 till July 2011
Dear Abhay
U require to pay PF and ESIC on the basic and D.A. from April 2011 and July 2011 and not on other perks of your settlement. But to deduct PF and ESIC on the ex-gratia amount of back 4 months is mandetory.
