Hi, My company has been delaying my salary every month since months ago. To be exact, the basic salary which should be credited to me on every end of month, but I'm getting it mostly on the next month, and even delayed until the 2nd week of the following month. I heard that there is a law indicates that salary shouldn't be delayed until 7th of next month.
Now, I have intention to leave the company, because I can't stand the company's situation anymore, and I have an offer from outside. And I do not really mind about the delayed salary (today is June 9 and i have not receive May salary yet). My company resignation notice is 2 months, and the job offer that I have is urgent. So, my question is, can i avoid the 2 months resignation notice period by using the salary delay as the reason? Can I immediately leave the company by this reason? Or 24 hours notice? Even if the company bank in the salary to me tomorrow, I will not stay either. Am I considering breach contract? Where the company has already been breaking the labour law many times before in term of salary delay. And I do not mind if the latest salary is not given to me anymore if I leave immediately. But my immediately doesn't mean on the spot, of course. I'm a professional, I will make sure I handover the work in my hand to my replacement or someone, and I can afford to do this for a week for the sake of the company's work progress and also my own reputation.
Appreciate for your reply. Thank you.

I am very confused with ths situation. Please help me.

I am now unemployed and studying some professional course. I worked in a company for only four months. My PF and ESI deduction was Rs 924 and Rs 254 per month. I went to the HR Dept. of my company and asked for PF formalities. As per my company's HR I can not withdraw my PF and it required minimum 6 month job in the company. He suggested me to transfer th PF. I know it can be transfer but Now I need money as I am unemployed. I quit the company on march 1st, 2011. Now it is almost 3 months passed. I enquired and find that I can withdraw my PF. I donot want to go again to my office and argument with the HR team. I want to carry on withdrawal process my self.

I have my PF number.

I know the PF OFFICE in Bangalore reagion which is related to my company's establishment code.

I have salary slips, Joining letter and valid bank account number with passbook.

My question is how can I withdraw without the help of Companies HR and what is the procedure. From the last one week I am unable to find the exact answers whom I asked and explain the senario. Please help.
