Absconded tcs in probationory period - what kind of action do i have to face?
Hi i absconded from tcs in the probationary period and i am on the bench for my onemonth stay in the company. according to my offer letter there is no bond. and it is mentioned that if you are leaving the company either you have to serve a month s notice period or you can leave by paying one month s basic salary. but there is no specific clause for a probationary period. for the probationary period they mentioned it as the company has the right to terminate the employment of the associate if his standards are below expectations in probationary period. as i was not allocated to any project i kept mailing them saying i could not continue my services due to personnel problems and after i stopped going to the office. after one month of my absconding i received a letter from them saying you have not been attending to your services for the last 30 days. please report immediately; otherwise disciplinary action will be initiated as you are in a probationary period. my concerns: 1 what kind of action do i have to face? 2 what are they expecting from me? 3 will there be any clause specifically for a probationary period? please help me with this.
Probationary period not confirmed in writing but notice period is required to be served for 90 days
Hi all i joined a company on 13th september 2021 and my offer letter agreement states "you will be on probation until successful completion of the probationary period is confirmed in writing." the notice period in probation period is 30 days and once confirmed it is 90 days. i have resigned on 20th september 2022 and my probationary period was neither confirmed before my resignation nor it is confirmed till date in writing as per the agreement. so technically i think that i can terminate my service by giving 30 days' notice period. however as per the resignation acceptance email my notice period shows as 90 days but i cannot serve 90 days' notice period and wants to serve only 30 days both due to requirement by my future employer and as per my existing company offer letter agreement. i want to understand the legality of my notice period as per offer letter agreement and the possibility of early release if my employer doesn t agree for any type of negotiation. please advise.

I am working for a startup company of size 20 from 19th sept16 till now and i have placed my resignation on 11th jan17 and agreed to serve notice period of 45days as stipulated in the termination clause. i just recently found that there is a line probationary clause that says "termination clause is applicable to probation" below is the probationary from offer letter probationary period the employee shall be on probation for a period of six 6 months from the date of joining. the company shall be entitled to forthwith terminate the services of the employee and this agreement at any time during the probation period. the company may in its sole discretion extend the employees probation period based on the employees performance conduct and/or other factors as the company may deem fit. the employees probation period shall not be considered to be completed unless the employeesservices are confirmed by the company in writing by a letter of confirmation. the provisions of clause 10 shall not apply to a termination under this clause. probationary period does this i mean legally i am not obliged to serve notice period?
Resignation during probationary period - company to pay for notice period?
One of my friend has worked in an organization for 5 months 25 days and the probationary period in that company is 6 months following are the ammendments that organization has in appointment letter. a they can terminate the employee if the services are not satisfactory during the probation period b if the employee has put down his resignation in probation or in permanent employment he/she has to serve 3 months notice or pay the equivalent amount. here is my question my friend has dropped the papers in probation and organization has relieved him within 7 days of time since he is not not been given an opportunity to serve the notice period we would like to ask for the 3 months salary from them please let me know if i am correct.
