Dear all
We would like to initiate disciplinary action against one of our worker who found guilty of misconduct ie to stop annual increments. But in the certified standing orders of the company it is not mentioned that how many increments can be stopped. I would like to know whether the company can stop four annual increments or it is two as mentioned in model standing orders. Kindly advise me.

Dear Riya
Even in Government offices maximum 2 annual increments only being stopped. If you stop 4 years annual increment, then you will have to lose the employee.
Actually what is the misconduct happened found in your worker? Have you served the Show Cause Notice to the worker? Was the Board of Inquest/Court of Inquiry held? Have you announced the findings and recommendations of the Board/Court to the worker? Has he accepted his fault?
Without any clear postings no one can give any reply to your thread Riya.
Always give required information specific to your issue to get proper response from the members.

Thank you for your response. We have conducted domestic enquiry and complied with all the requirements under labour law. We have given the enquiry report to the worker and obtained his reply also. Final order is pending. Please note that in our certified standing orders how many increments can be stopped is not mentioned. I would like to know whether there is any condition for the number of increments can be stopped.

Dear Riya
In Defence only 2 years increment only can be withheld as a punishment and not more than that. As your company's discipline-policy is not clear about withholding the increment of any employee, you can adopt only general practice to follow by other government companies. Even his seniority also to be reduced only maximum period for 2 years only which is being counted for his further promotion. Considering his severity of the offence, you can award the punishment.
