Dear Seniors,
we are a Pvt. limited company since 2006. I just came to know that we are not registered under Delhi shops and Commercial Establishment. now I though to get registration and contacted to labour department of Delhi.
They told that there is no fee and documentation required like earlier. it can be done online. when I asked about labour welfare fund they told that is different thing which has no link with this act.
my query is:
1. as we are too late to register, do we need to pay any late fee now even though there is no fee charges for this now.
2. is it compulsory to pay LWF, if yes, is there any registration for same.
3. what if LWF is compulsory to pay, do we need to pay all the amount since 2006 or we can start from now on..
pls answer..

Dear Nishu

That registered under Delhi shops and Commercial Establishment is mandatory in Delhi region and you can get your company registered under the provisions of Delhi shops & Commercial Establishment Act online. You have to fill the details like name, father's name of the employer, nos. of employees working in the establishment, name and address of your company and you will get your registeration online immediate after submitting your details. There is no late fee of charges, but you have to registered your company immeidately as it is mandatory for all, otherwise the labour department can prosecute your company as well as your employer (director of the company).

About welfare fund, yes you have to start depositing the labour welfare fund immediately and you should also deposit the labour welfare fund since 2006 also, for all the employees except those working in the managerial or supervisory capacity. It is only rupee 0.75 of employee share and rupee 1.50 of employer share of contribution for the employee their name is on the roll in the month of June 30, and December, 31 of every year. Means, your company is employing 30 people, then your employee share of contribution is 30x0.75=22.75 and employer share of contribution of 30x1.50=45.00 and you have to deposit Rs. 67.75 in the Punjab National Bank at any branch of Delhi through Challan of Labour Welfare fund and thereafter you have to send the detail along with Bank Challan. It is mandatory/compulsory for all the establishment which are working under the jurisidiction of Delhi otherwise the Labour Department will prosecute for the same. Dear Mukesh,
we have two locations in same city (2-3 Kilometers away). as I know both the locations has to be registered separately with separate registration numbers. so in case of employees also we need to show the only the employees sitting in theses premises or working under theses locations OR we should mention total employees in both the locations contexts. please help..

Your both the locations has to be registered separately with separate registration numbers and you have to show the employees location-wise.

hello mr. mukesh...
i want more information.
we registered our company in delhi shop act on dated 19/12/12 online...there was no online fee...we just got form c registration certificate of establishment....but when MCD inspector come to our premise they check the form c on dated 26/05/14..
they told us you will have to renew delhi shop act certificate every year.....
in this regards i just want to know that how can i renew the delhi shop act certificate...or is there any license fees every year like factory act...i have no idea regarding delhi shop act....
please help me..how can i renew it...
