Continuous absenteeism - action to be taken
Dear all can anybody help me to sort out the following problem. in my company 3 dailyrated monthly paid permanent workers are absenting from work since 19/10/2007. in our standing order it is mentioned that after 8 fays of continuous absence it is presumed that the worker has voluntarily left employement. i have sent registered notice asking the workers to show cause why action should not be taken against him for unauthorizedly from work. it was also mentioned in the notice that if no reply is received within 3 days it would be presumed that the worker has voluntarily left employment and his name will be removed from the rolls of the company. one registered notice returned mentioning that the addressee has left india. the other notice was returned mentioning absent the other notice was received by him but no reply was given. it is clear that they may not have any intention to continue in employement since they have not given any reply nor received the notice. what is the next step i should take in this situation. do i need to send him another notice under certificate of posting. do i need to conduct a domestic enquiry to remove him from the rolls. please also let me know what is the procedure to be adopted in such situations. regards sebuks.

Dear all need a small clarification on esic deduction and its appilcability below are the queries: 1 is esic is appilcable on the daily wages? if yes. than please let me know the section of the act which have provisions of the same? 2 suppose if a daily wage worker is getting a wage of rs 650 per day and he is earning above rs15 000/ per month than whether esic is applicable for him? 3:is esic applicable for the employees of the company if management has taken the accident policy and workmen s compensation policy? we have a big group working for us and they are paying daily wages to worker and according to them esic is not applicable on them since every worker is withdrawing wages above than 15k in a month? please advise. ranjeet

Hi i am an hr in an it mnc company. my company makes the freshers sign a bond which simply says that if they do not complete their 1 yr in this organisayion they will have to pay 1.5 lacs to the organisation. one of the employee had signed a bond in our organisation. now the employee on completion of his 3 months has left the organisation. i have a query if we as a company can send him a legal notice and what would be the consequences a company can go through. also wanted to even ask if bonded labour is allowed in india.... pls help.
