Hi Gurus
i want to know few things regarding the accident in office premises.
1) What if an employee is not under ESIC and met with an accident in the course of employment?
2) Is company liable to pay his hospitalization expenses?
3) What if an employee going for a visit and met with an accident and he is at fault.
4) Is it ok if we have Accidental and Medical Insurance of employee to avoid further liability?
5) What is the deferance of permises & precincts

I would like to clarify regarding the accident in office premises. If an employee who is not covered under the provisions of ESI Act and mets with an accident during the course of employment, then the employer is liable to bear/pay all the expenses like hospitalization and for compensation if any permanent and/ or temporary disability. Yes, in case of, if an employee is going for a visit and met with an accident and he is at fault also. Goot if company get their employee insured with the general insurance under the Workman's compensation policy, then there is no liablity of employer in respect of accident occures in the course of employment.

Let me clarify your questions one by one
1) if the employee not covered by ESIC then he would be covered under Workmen compensation Act which now changed as Employees compensation Act.
2) Employer has to bear all the medical expenses in case if the employee not covered under ESIC.
3) If the employee met with an accident during the course of employment the entire liability lies with employer.
4) There are certain provisions where you can reduce the liability if the same took place because of fault of workmen.
5) In such cases also employer cannot evade him self from the liability but restrict the same because of contributory negligence.
6) It is always safe to take group accident insurance scheme to reduce the liability of the management.
