Dear Sir
An employee will be entitled to gratuity under the Payment of Gratuity Act only if he had completed five year of continuous service and his services with the employer comes to an end on account of resignation, retirement on attaining the age of superannuatio or death. Employer is liable to pay the gratuity amount only when the employee leaves the services of the company not during every year.

Gratuity is one of the benefit of an employee and it is paid only he serves the organization continuously for 5 years with any break in the services. The payment of gratuity is done only when he/she is separated from the company, not every year after he completes the five years of services.

Hi,
Just want to know if company terminate employee for any reason definitely not for misconduct when employee is entered in his 5th year service with company.
1) Is employee liable to get the gratuity in such case.
2) If gratuity amount is included in CTC. Then at the time of F&F gratuity amount deducted every year should be added in F & F or not.
Pls share your views on same

Hi,
Its basically retrenchment.
Basically company has included Gratuity component in their CTC calculation. So every year when they revise the salary it get calculated and that amount is considered in CTC. Employees are covered under the Gratuity act. So whenever new employee joins company Gratuity amount is a part of CTC
