Dear Seniors,
I have a query . I am working in a Private firm and covered ESI Bracket. As our employer is deducting employer and employee share both from my salary.
I would like to know the benefits under ESI scheme for the women employees especially under Maternity benefit. Our company has the policy of giving three months leaves for maternity.
Can the person avail the leaves from company and also in addition to three months leaves approved from ESI Medical Officer at the same time.

You can not avail both the leaves at a time. Usually, companies grant leave under Maternity Benefit Act if ESI act is not applicable and vice versa.
ESI benefit is payable for 12 weeks (3 months) which can be further be extended to 16 weeks i.e. 1 month more on medical or sickness grounds. Eligibility is the woman must have worked for 80 days minimum in 12 months period.
