Legality of holding up salary of employee during notice period
Hello there... i need an urgent help in this matter.. case: employee at managerial position in a private co. places resignation with a willingness to work during the notice period of two months..resignation placed on 2nd july 2009 for which the notice period ends on 2nd sept 2009.. now can the employer co. hold the salary for the month of june 2009 alongwith the notice period of 2 months of such an employee saying that it is the policy of the company...and shall release the payment only at the time of relieving the employee... is such policy be considered legal...? is there any remedy to such an employee..? please help me out in such a situation as the employee in above case is myself.. regards pankti
Leave policy and resignation notice period
Please suggest me that in case an employee resigns and the resignation period being one month and the employee has also applied for his privilege/ earned leaves for a week or two during his notice period as well and still has left with leaves in his leave bank. kindly guide me whether we shall include or exclude leave period from his notice period and take the effect date of the notice period after his leaves are over as there is no mentioning in the leave policy that the leaves if granted during the resignation period shall be included/ excluded in the resignation period.
Legality and need of resignation acceptance letter
Dear friends i am a working professional. need your help on following. i joined my current co. on 16th october 2017. after joining the co. i found out that the co. is not as good as it was expected especially salary never comes on time. as salary for october itself is due and the appointment letter does not mention any clause on salary credit date. further luckily i got job offer from a very good co. but they want to have at least resignation acceptance lfrom my current co. my co. managing partner is dilly dally in accepting my resignation in mail though he agreed over phone. kindly suggest me what is the legality of resignation acceptance letter? further as i came to know and saw many new employees left the co. without even giving proper notice just informing over phone. the co. is a short of startup and hence everything is controlled by one person that is managing partner. i have given proper notice i. e. informing verbally and then resigning in mail. i have requested them for early release that is less than one month notice period. i am alsoready to pay notice amount but doubt they will give acknowledgment of the amount being credited and relieving letter. my new co is ready to buy the notice period also. please guide me as i have resigned from current co but unable to join new co as the resignation acceptance is not there in writing. please suggest what measures i have before me.

Hello connections i have a doubt related to the notice period calculation. resignation date: 10th june resignation acceptance date: 28th june notice period as per the company rules is 2 months what will be his last working day if he serves 2 months notice . 1 from which date is notice period will be calculated? from resignation date or resignation acceptance date? 2 how much time an employee should wait for the response on his resignation email? if he doesn t get response within a week the resignation can be considered as accepted? 3 if his resignation is not accepted what are the exit formalities?
