As Iam working in poona Hinjewadi graphic companyfor last 4yrs and 10 months with only first shift (morning shift) but now suddenly managers ,AVP,VP has said to come in night shift compulosry or take decision, but I am not ready to do night shift as well as to resign .
is there any rule that we can continue with morning shift or we have to do night shift
As well i am doing maximum OT as they are saying if u r not doing night shift u have to do OT maximum

You are always bound by your service rules. The Standing Orders normally will have an order that every employee shall follow the timings fixed by the departmental heads as mentioned in the roster or as published in the notice board. Therefore, if the manager/ VP or whoever has directed you to report to night duty, you have to follow it. It will not even make any change in the service conditions also. A 48 hours notice is sufficient to change your shift timing.

If your nature of work requires you to perform your work in shift basis & if your employment rules provides so, you are required to obey the change in shift. Not accepting may amount to disobediance of order which would attract disciplinary action.
However, you could examine yourself the situation that arouse why were not disturbed for 4 yrs 10mths and you were suddenly disturbed. The result of examine of the said issue would give you some reasons which can used for retaining your 1st shift working times.

as u have written that u r associating the company more than 4 yrs. you must first register ur negation thereafter take decision over it though i must say need carry on ur duty in night every thing will be resumed as let the time come.

There is provision in ID Act that the tradition may not be changes suddenly without taking employees or their representative into confidence.You may raise complaint with the local labor commissioner in writing. Before that you may consult your other colleagues and try to know what are their views so that you may get their support. Night shift poses health hazard. It disrupts melatonin secretion in the body. Dear All,
First of all there is little what we can do about the duty timings. It's depends on your service conditions issued to an employee at the time of joining duty. Most employer mentions '....timings as prescribed by the competent authority from time to time' etc. So I don't think one will have any option about it unless one has the bargaining power and the person involved is inevitable for the employer. May be he may try through medical grounds to avoid continuous night shift. If it is going tobe rotation he can't refuse.

If you do not want to switch to nightmshift, and your company requires you to, giving you no option, then you should seriously be looking for a new job. There are no shortage of jobs for experienced people in your line of work.
You can not really survive in a company by forcing senior management to reverse their decision on something related to business requirement.
