Sir,
I am at present working in a PVT company,
Recently I got job in a Central governement , so i want to move to the govt job. i have to pay now 50000 amount in the company if i leave job.
But I heard that, no need to pay amount if job is in govt sector. please relpy my question.

It is not because you are joining a government department but because of the fact that employment bond is illegal that prevents the employer from recovering the amount. However, the employer can recover any cost incurred on your training and development.

Hi,

Any company in the offer letter mentions terms of employment. Look at your notice period clause in case of termination. In most of the companies you are required to give 30-60 days prior written notice. Also there is a mention of notice pay recovery depending on your requested last working day. If it falls short of the notice period then they may ask you to pay money.

If there is no legal aspect towards notice pay in your offer letter then whatever you and your supervisor mutually decide on your last working day holds good. Out of goodwill and service with the company a notice of 1-2 weeks should be given to handover your work and train a new resource in yr place.

Hence look at your offer letter closely then see what the terms are mentioned. If you do not wish to serve the notice period you may leave however your employer may create difficulty with providing a service certificate and releiving letter so its better to leave your current organization on a good note.

If required you can buy the notice period and ask the company u r joining to buy your notice period.

Dear Friend,
Its Dem sure that if have singed the contract then you have to give the notice period n if ur not serving the same the written amount can claim by the company. its not any bond its a service agreement. do one thing just talk n convene with ur senior for ur career. and if they denying the same
then serve the notice period to them
or stop working n sit Idol between the working hours.

Dear Priyanka and Sourabh,
A service certificate from a private company is worth less than a bit of paper when you join government department. It after a thorough process of written exam and interview that he has obtained a job in Central Govt. Do you think that employer will do any harm to him? Can you site any example that any employer has gone against an employee who has not paid the notice pay or agreed bond amount. Service agreement restricting one's mobility to also void. Therefore, the employer's intention (if any) to collect Rs 50000 for relieving will not be maintainable.

If we can not convince the seiners, obey the rules because we have signed the agreement with our knowledge. And siting Idol between the working hours is not a solution, If Sourabh a manager will he allow his juniors can do this?

In the govrenment eye this kind of bonds are illigal,
they can not claim money, if you are not serving notice period they only can
keep 1 month salary of yours, whatever the amount comes everymonth,
not more than that,
they can not do anything,
look your future if you have time to serve notice period better you serve if u do nt have time then let them keep your 1 month salary,

Dear All,
I fully agree with Shri Madhu Ji. But all cannot afford to give a tough fight to their employers and succeed. I would therefore suggest that Shri Raju Ji applies to his employer for condonation of notice period/ notice pay of Rs.50,000 on the ground of compassion. He may plead in a written request that he does not have sufficent funds to pay to the employer, his new employer would not give him extention and that he cannot afford to lose a golden chance for betterment in his life. This may work. The employer may condone the notice pay and relieve him of his duties. Let him try this. If does not get positive response from his present employer, then he may follow the advice of Shri Madhu Ji

Dear Madhuji,
Generally companies r not going to sue due to long legal procedure, but Its confirmed that if you singed a contract then u have paid the Service bond amount because its a breach of contract not any bond amount. bond word is not valid under 27 section of Indian contract act 1972.but agreement word is valid.
U can also do one thing, just take leave for the 10 days by this u will get rid of from ur job due to no leave intimation clause in your contract.

Dear Madhuji,
I agree they cant force you to recover the money however they can stop payment on your salary due to you and can delay in your relieving letter. I have seen many companies do this.. Also they can adjust the money against your leave balance which are usually encashed at the time of leaving an organization.Hence its better to leave a company on a cordial note.
State to them that you are not keeping well and take 1-2 weeks off and then talk to your supervisor to relieve you early as you cant attend office.. Even though they have the ball in their court with the contract signed , however they cant force you to serve the notice period. Hence if you take leaves and sit at home they will be forced to relieve you early.
Hence its nothing to worry. Wish you all the best for your new job.
