Good morning seniors..
One of our employee has given 2 years bond now he has given resignation. Mangement asked me to send a letter that accepting the resignation but ask him to pay all expenses which company has spent on him.
Please give the letter format to send him.

Dear Aruna,
If an employee has signed the bond and later is he / she resigns from the company, that employee has to pay the liquidity damage to the company.
Liquidity Damage is the amount which is mentioned in the service bond...

The Bond is most disputed aspect of contract of employment. Before expressing any opinion, I wish to go through the terms and conditions of the Bond. Please attach the Bond copy. The Supreme Court and other High Courts has on many ocassions given the decisions against the company who attempted to enforce the bonds from the employees. We need to study the case.

yesterday we came to know that he is fraud, mischeated customer money by using office stamp.we have given complaint, given paper add also. But here i want to know one thing that, customer is coming and asking for their money. Is company need to pay loss amount.
Please i will ask my doubts regarding this case.

Dear Aruna,
I may suggest, based on your input, as follows -
First of all you have to examine all documents to form your conclusions, prepare documentary evidences of frauds carried out by him. Institute a domestic Inquiry, obtain the orders of the Inquiry, file a charge sheet, file an FIR with police under IPC etc.
In addition to the above send letters individually to all your customers that he is nomore with yr. co. and they should not deal with him anymore. In his place so and so is engaged to deal the matters with them.
For your company's safety caution all your customers not to hand over any cash and all payments should be by crossed cheques.
Examine the documents of your customers and arrive at conclusions, put up the conclusions to yr. management for a decision.
