Hi all,
Would like to have clarification on these following points.
  1. If an employee leaves a Company before completion of his Probation and as per the offer letter it is not necessary to submit Notice Period during Probation. But still he gives 15 days Notice. Then, whether he will receive the Salary pay for the Notice Period (15 Days)?
  2. Notice Period is counted as Working days or Non working days?
  3. If a person submits a Notice period of 15 days on the start of a particular Month and his last working day is 15th of that Month, then what will be his No. of Working days in that Particular Month and whether he is liable to receive the salary of that particular month in his full and final settlement?
Kindly provide your opinion on the same. Looking forward for an insightful discussion.

If during the said notice period of 15 days he works, he is naturally eligible for that 15 days salary. Why should there be any confusion? His full and final settlement will be taken after taking into consideration that 15 days salary only.

Hi Zareen...
Even if it is not required and a person gives notice period during his/her probation (S)he is liable for 15 days salary.
As Madhu Said there is no confusion at all.

Dear Archana,
Thank you so much for your revert. would appreciate if you could also provide me clarification on below mentioned Full & Final Settlement Calculation.
Working Days in Feb.’11 07 days
Casual Leaves 05 days
Earn Leaves 11 days
Total Days 23 days
Less: Notice Period 15 days
Balance days (Paid) 08 days
Total amount paid for 08 days Rs. 5710/- with Rs. 10000/- last month balance.
The person has served 15 days Notice Period i.e. 1st Feb'2011 to 15th Feb'2011. Out of those 15 days he has gone on approved leaves for 7 days and that too with the consent of his Reporting Manager.
So as per my understanding he should be given 24 days Salary for that month (15 Days Notice Period + 9 Days Leaves Balance), considering 7 days (8th Feb'2011 - 14th Feb'2011) adjusted.
Please provide whether this is a right calculation?

Dear Zareen,
Still you need to understand some important things before making any full and final of above said employee.
a)Notice period given by employee for 15 days ,however his working days is only 07(7 working days including weekly off or holiday....) and what is your monthly wages calculated by 30 or 26 days?
b)Please do not include CL if he/she not applied for it and do not adjust EL in notice period which is not required by law,if your company is doing this practice then no problem to includes all leaves.
c)At the time of full & final,you need to give total working days+ CL if he/she already applied for it+wages of EL balance at his/her leave account.
