Hello Seniors,
I have been working for a company deals in imported Revolving chairs in sales department. i have been getting orders from my old customers but there was no new deal finalized due to our product price and design were not new as per market demands our selling is through architects i was able to generate the leads but due above mentioned reason deal was not finalized and due to fall in my sales my company has not paid me salary for January (paid some amount of salary) and nothing for February and he claims back to me that i have not worked for all this days and i have been time pass. but at the same time he is not even refusing to pay he says he does not have money to pay me and he has paid the salary of other sales people.what legal action can i take against him as i don't have enough time in my hands i have got the job abroad waiting for visa to come.please due guide me on this asap.

drop the idea of recovering salary through legal means.. it is time consuming affair and requires lot of effort on your part as well. for a months worth of salary it is not worthwhile taking legal actions. Just keep a strong follow-up with your boss for salary and focus on your work till you can get a better job. Legal action is advisable only if the amount involved is atleast 3-4 months of income as it is expensive and time consuming.

I have 2 experience of big mfg. Organisation.due to marriage resigned and shifted to home town.as there is no option of proper HR job, instead of having gap started working with small consultancy employee strength 2.They didnt have letterhead etc. So i dont have any document of employment.even salary was in cash. Now shifted to mumbai and have offer to work as HR. But they require documents, pay slip, bank statement of that consultancy .I dont have any proof. That consultancy can provide me only printed documents which will have stamp and signature.
For initial two years of employment i have all the documents from mfg.company.
Will upcoming company accept my candidature?
