Dear All,
Can anybody please clarify my query.
When an employee expire after serving 5 years in an company at the age of 30 and still has service period up to his 58th year. How would the grautity be calculated and dispersed to his dependent.

Dear Mr. Elavarasan,
As per Gratuaty act if a person completes his 5 years service then only he is eligible for gratuaty, after serving 5 years he expires then we should calculate the grautity = last drawn salary basic X 26/ 365 * service rendered.
Let me add to what Abbas has put that gratuity is calculated without any reference to the age of the employee and his remaining years of service. Similarly, in death cases the qualifying service of five years is not required.
