Dear Friends,
As per Maternity Benefit Act'1961 any women who has worked at least for 80 days is eligible for Maternity Leave. Now my query is : Can a probationer women is eligible for Maternity Leave who has worked more than 3 months or more?

Dear Mr.Rahul,
As per ESI act there is no question of Permanent, Probationer, casual coolies. All are treated as IP. If she is contributing for ESi for 2 consequent period. she is eligible for maternity benefit. She will get benefit as per her daily wages rate for 84 days. Also if an IP is need not obtain form 21 & 23 forms from ESI dispensary. She can produce birth certificate and requisition letter stating she was taking maternity in her native place after delivery of one month. This letter and certificate you have to submit to respective branch office. The branch office will forwarded to SRO and get the approval.She will automatically get benefit.This will possible even though she is not yet registered her card in her respective dispensary.
