Dear Friends
I wanted to clarify if an employee is not covered under ESI. It means we have to give same ESI benefit. That is 12 Weeks of pay pre and post delivery. And how many days she has to work for this pre and post.

If a female employee is not covered under ESIC then by default she will be covered under The Maternity Benefits Act, 1961. The Maternity Benefits Act, 1961 has no wage ceiling as in the case of ESIC.
Leave benefits under Maternity Benefits Act are almost same as ESIC. Plz go through the Act.

@kprasoon: please clarify. As we all know that ESI ceiling is of Rs 15000. So, if a woman employee has earning of more than Rs 15000, is she still get ESI benefits. Is there any relation between Maternity benefit act and ESI in this respect?

wage ceiling of ESI is applicable for all...male and female employees so there is no question of getting benefits if gross salary is above 15000/-.
There is no relation between ESI Act and Maternity Benefit Act..both are different acts.
