we have a small back office operation. and it is under shops act. i have few questions about insurance in case of accidents and deaths at work place. Also about accidents or deaths that may happen to a staff while trying to reach the workplace or when leaving the workplace to go home? since our office has only 5staff, by law we are not supposed to contribute towards EPF and ESIC or any other state insurance scheme. I would like someone to tell me what if my staff dies due to some accident at my workplace or some accident happen to my staff at workplace? will i be held liable by law to pay compensation for the death of the staff ? also if its an accident that happen at my workplace, am i as an employer by law liable to pay for his treatment ? and how much will i have to pay in case my staff dies ? can i buy life insurance policy and mediclaim policy for my staff so that in case of death of my staff, i would not be confronted with paying a huge compensation to my staff's family? please any1 guide me! thanks to all.

My father was a driver(family driver), he used to go to work early to avoid tardiness and of course to clean the car before they leave the house. One day, after cleaning the car around 8 in the morning (shift start around 9am), he rest in gazebo, then one of the neighbors maid saw that my father was unto deep sleep or maybe the term she used was heaving difficulty on breathing, then the maid ignored it, then couple of mins. she saw my father fall asleep. So she wake her up, but that time my father is already dead due to heart attack. So that maid called the attention of my father's boss and told what happen.

Then, they contact the security guard, then worst of it, they were told that no one should touch my father (well how about at least try to salvage my father??!!) so they contact the brgy. and they also contact police "SOCO".

That was around 9am in the morning. So they tried to contact us by checking my father's phone and contacting common friends just to let us know what happnd to my father.

GOOD NEWS!, is that we received the news, and that was around 2:00PM!!!!. so I went to that village to see my father. Since the village was far from our house, so I arrived past 3:30PM.

Imagine, my father died around 9 in the morning, they called police"SOCO" instead of AMBULANCE since that was EMERGENCY, not MURDER (correct me please if I'm wrong). Then I got his cold, hard, and dead almost 4PM.

He was dead, no one take the risk to rush him to hospital, I found him like a dead animal sitting on the gazebo. How hard it is for me. Then Her boss gave me 2500 pesos as the last salary of my father and promised that they would help us. Been more than a week, but still we haven't received any help, nor they didn't showed up on my fathers funeral.

Is there any legal thing that we can file against them, or since my father died cause of heart attack, then we can't do anything. Any feedback will be highly appreciated from you guys!
