Hi Guys,
This is Ariff from chennai, could you plese clarify the below point;
The women is entitled to get maternity leave for 12 weeks ( 84 days); To calculate this 84 days, we should count the weekly holidays and declared holidays.. is it right?

From India, Madras
Weekly offs and holidays which intervene the 84 days of maternity leaves shall be taken as maternity leave days and no separate treatment by granting compensatory off/ holidays in addition to 84 days will be permitted. The treatment is same as if one has availed Earned/ privilege leave.

Can anyone tell me wheather we can combine maternity and earned leave.Also let me know is this is the correct formula for earned leave.
Gross salary/30*15*No of earned leave available leave.
Thanks & regards

There is no legal restriction for combining maternity leave with earned leave. Therefore, you can allow the employee to combine maternity leave with earned leave.
Earned leave is usually worked out on the number of days worked. It is nothing to do with salary of employees.
If you meant to ask the formula for encashment of earned leave, you can take the gross salary and divide it by 30 which will give you daily rate of wages which can be multiplied by the number of days leaves to be encashed. Instead of gross salary some companies take Basic +DA only for calculating leave encashment. But if the salary is structured in such a manner that only gross salary is the actual salary offered but for the sake of convenience (of the company) the same has been split in to various heads, it is advisable to take the gross salary for encashment.
