It would be necessary to distinguish lay off in establishments employing less than 50 employees, establishments employing 50 but not more than 100 workers are employed and wherein not less than 100 workers are employed. Naturally, the establishments who do not employee 50 workers cannot declare lay off and in case workers are laid off they should be paid full wages. Establishments coming in 50-100 group can carry out lay off without approval from the appropriate Government but only an intimation is required to be given. At the same time, establishments employing 100 or more workers should take prior permission from the government for declaring lay off.

The reasons or grounds on which the lay off can be declared shall also be given in the document because it is a general feeling that we can lay off even for financial reasons. Therefore, an interpretation of section 2(kkk) is very important while preparing a note on lay off.

It would be proper if you give a text of conditions precedent to retrenchment as detailed in section 25 F (in the case where the number of employees is less than 100) or 25N (in the case of establishments employing 100 or more workers to whom the chapter VB will apply)

It would be good if you give an idea of section 25FF relating to transfer of undertaking and closure of undertaking as per 25FFA or 25O.

There are different forms under different State Rules and Central Rules. I think the attachment are the forms applicable to West Bengal and not Central Rules.
