Hello Seniors/ Friends,
I have joined an organization on 12th July 2010 and left the same on 6th January 2011. Technically, its 5 days less than 6 months in the calendar. Now, am I entitled to get the encashment of Earned Leave accrued in my account? Can July 2010 be counted as one month as I joined before 15th of the month? Please help me with your valuable suggestion and advise.

Dear J P Das,
First see under which of the Act / Rules you are entitled for earned leaves & then go through the provisions / Rules relating to grant & encashment of EL under that Act / Rules to see whether you are entitled to encash EL. You can also approach your HR department for this purpose.

Hello All
I just want to confirm that if company is covered under Delhi Shop & Establishment Act ,can employee get PL encashment if he resign from the company and his credit PL is 45 days. Can legally he can claim or not.If yes please tell me the clause in Delhi Shop & Establishment Act.

Hi J P Das,
You need to refer the applicable local act viz. in terms of entitlement. For calculating proportionate entitlement, the actual number of days are taken into account and not the month.

Hi, If it is a factory, then yes, even if you have not completed 240 day. Sub section 3 of section 79 of factory act provides leave encashment at the time of quitting the job also. Rajesh Gupta

In my opinion, there is no word of leave encashment under any Act. Leave encashment concept is entirely subject to company's internal HR Policy which is communicated of employees at the time of joining.
Further, under Factory Act in case you applied for leave and the same is denied on the ground that there was some urgent work, and, you can prove the same. Only then there is chance your leave for that particular days can be reimbursed.

Dear All,
I sincerely thank all of you for your valuable inputs. I really appreciate this. The fact is that I have resigned from the company and total days of my working is 3 days less than 6 months.
Now, how many months a person has to service minimum so as to avail the encashment of PLs accumulated in his account. Am I eligible in this case.

Eligibility of Earned Leave is 240 working days in a calender year as per Factory Act,1948,but leave Encashmenet concept is differ from company to company because this is depend to company internal HR policy which is communicated of employees at the time of joining.
