Whether overtime has be paid even for half hour work extra?
Dear all we are a company registered under the shops & establishment act. we pay overtime to our staff who put more that 9 hours of work per day. can anyone help me to understand whether overtime has be paid even for half hour worked extra on any particular day or it requires atleast 1 hour work required to be eligible for the overtime payment.

Hi guys posting here for the first time so not sure if i am posting in the right place. and sorry for a very long thread i have a a small private graphic company owned by me and have 3 employees as of now. recently i am getting very frustated with out put of employees going down . they are taking too many holidays citing silly reasons like feevr going out of station some important work a home. till now we have always tried to not deduct salaries of our employees if their reasons were genuine trying to be a good employer but i have realised employees tend to be employees. they just want their salaries at the start of the month and they are not bothered where the money would come from if they take too man offs. so now we want to put strict rules in office regarding casual leaves. the point is to discourage them to take extra holidays . maybe a way to pinch them hard whenever they take unneccessary breaks. so we were just wondering as to how to calculate per hour wages of the employees for eg with a monthly salary of 15000so that every extra leave is deducted from their salaries and they think twice before taking leaves. we have been really nice to them till now but the end of the day office is suffering and they are not bothered. please guide me with this. any other method to discourage them doing this as talking hasnt helped. i have done that 4 5 times. also how to calculate bonus for working overtime. we work from 10 7 with a 1 hour lunch break whnever they want. sundays are off. also sometimes they dont have work and they leave early also so does that compensate overtimes? for eg if they worked extra half an hour and then next day left half an hour early does that balance out? we generally have saturdays working but when workload is not too much we take half day off. the idea is to compensate their extra working hours if they haveput during the month. please advice me on this. feeling totally frustrated with this now thanks and cheers

Regarding leave policy
Hi i am working as an hr manager in it company. at present company strength is 30. recently we came up with a new leave policy for our employees. i am sharing our company leave policy here. i have a few questions regarding the same. i would be really thankful to you if you can guide me further and clear my doubts regarding this. on 1st of every month every employee can have an addition of 10hours for the leave. 2. on accumulation of extra working hours we can generate a leave of 10 hours. 3. a person can accumulate a max of 200 hours. 4. the leaves will be of following types: a. full day: 10 hours b. half day: 5 hours c. one third: 3 hours please note that as per this policy the extra hours would be calculated after 6:45pm. so in this system we will require a minimum of 1 hour attend. so if you are moving out at 7:30 pm than you will not be credited with any amount. so minimum time require to leave the office is 7:45pm. also the hours will be accumulated with the difference of 30 min. say if you are leaving at 8 that still be counted as 1 hour. so there is the difference in that. also the hours need the approval from your tl and hr. other than this there are casual leaves emergency leave emergency leave without balance leave without pay.for applying to each of these leaves there is a separate procedure. my query regarding this is : as mentioned above on the 1st of every month there is addition of 10 hours to every employee account which is equivalent to 1 leave. also regarding the extra hours if anyone has 10 extra hours in his account that will make 1 leave. what about those people who are not sitting for extra time and completing their task on time and they leave office at 6:30pm. our office timings are from 9:00am to 6:30pmincluding one hour lunch break. i just want to ask if 10 hours 1 leave make any sense because as per the standard labour laws an employee cannot work than 9 hours a day. kindly help me regarding this. 2. another query is that suppose a person has worked continuously overtime and has 10 hours in his account which makes 1 leave for him. he applies for the leave and leave has been approved. however according to the weekly rating systemparameters that we use for rating like; efforts performance and discipline/attendance that we follow for apprasial . if a person has taken that leavealthough it has been approved we are still deducting points presently we are giving rating out of 5 for that. my team has a query that what is the benefit of that extra hours then if the points are still being deducted. i would really appreciate if you could tell me that what should be the best possible route to this and whether we need to change our rating criteria for performance appraisal. looking forward to hear from you soon thanks and regards shruti verma hr executive.
Extra working hours - can i challenge this in labor court as mentally and physically harassment?
Hi all i am working in an it company. my working hours are min 37.5 per week but i have been forced to work 42.5 hours weekly means avg. 1 hour extra daily except my lunchtime since last 3 years without paying any overtime even i also work on saturday once or twice in a month without getting any overtime payment. so can i challenge this in labor court as mentally and physically harassment? being forced to do extra hours without getting any overtime pay. please suggest.
Regarding extra working hours
Hi sir/ mam i am working as an hr in it company in mohali. present employee strength is 20 .i have a query regarding extra working hours in my office. our office timings are from 9:00am to 6:30pm. normally we allow people to reach office by 9:20max. after 9:20am if a person is coming without informing we mark half day . recently we have framed a new policy regarding overtime hours for our team members. if anyone is working after 7:00pm we keep a separate record of that many hours daily . if it comes out to be 8 hours after the total addition we add one leave to his/her account for that particular month. i would like to explain this using an example : if any employee left the office at 8:00pm 1 hour added and the next day she comes at 9:45pm we deduct that many hours from the previous day hours means she is late by 25 mins so subtract 25 mins from the previous day hours and so on... . however personally i am not convinced regarding this as i feel that we are not able to set a discipline in the office. earlier we use to reward employee every month with the "star performer of the month" award keeping in view his extra working hours as well as other parameters. i would like you to please guide me regarding this policy. is it correct ? i would really appreciate if you could suggest me some other alternative . looking forward to hear from you soon thanks and regards divya manocha hr manager
