What I feel is a company can not be a fool to mention a grauity payment (for which you will be eligible when you leave the company...the future amount) in your CTC. What they must have mentioned is grauity contribution which is 15 days salary (basic+DA) that an employer contribute every year in the grauity fund towards its liability for the payment of gratuity to its employees.



You can easily calculate your 15 days fixed salary and the gratuity amount they have mentioned in your offer letter. It should not be more than your 15 days (basic+DA) salary.



Gratuity contribuition cannot be deducted from employee's salary. It is employer's liability and there is nothing wrong either legally or ethically if the employer is considering it as a part of your CTC.

Comparing something for which an employee is a direct beneficiary with electricity costs, paper/stationery costs, depreciation of chairs etc. (which comes under the administrative expenses of the organization) is somewhat derailment of the discussion from its point.

I dont understand how mentioning gratuity contribution as a part of CTC will undermine an employee's dedication and loyalty towards its employer.

Mr. Kamal,
Mr. Madhu has easily and exactly express what an employee feel, how do you know that employee is going to work for your organisation for more than 5 years.
If he leaves job because of some reoson then you will not pay is amount deducted against gratuity.
As gratuity is employers gratitude towards employees long term of service, so how can employer will start showing his gratitude towards employee from first month ??????????.
This type of employer is making gratuity - a component of salary and diminishing its actual value.

When we discuss about CTC/Salary need to understand the difference between deduction and contribution.
Deduction is wrong...Contribution can not be termed as wrong.
Making gratuity a salary component is unfortunate.
Gratuity is not only employer's gratitude (at will) towards its employees ...its a statutory obligation of the employer also.

Hi Madhu,
I was working in an organisation for more then 5 years. After Resignation the company not paid me the gratuity amount saying the it is not doing well. I have submitted form i and even i have acknolodement for that. I have filed case in labour office and already 3 hearing are done. In every hearing the opponent advocate will ask time and hearing will be post phoned to next date. How long it will continue and whether i will get my gratuity money?. I have all supporting documents (joining letter, releaving lettter, offer letter, salary slip).

Dear Sir,
I was working in a company in third party pay roll from last six years (sep 2009 to may 2015) and i was complete my notice period. But when i ask for my gratuity they denied for that you are not eligible for gratuity because i was in third party. And these are things not mention in company agreement pls advice.

This is Salim. I have resigned from LTD company before 3 months ago. My total working years are 7. I have aked to HR for gratuity, they replied it is not in company practice. I have sent 3 repeated emails to HR demanding of gratuity but no reply from there.
I have planned to send FORM-I. But if they ignore FORM-I then what next ?

How many employees are there in the company??
If company is legally bound to pay gratuity and does not pay,just approach your local labour officer and complain in writing.
The company may not have a practise of paying gratuity but they are legally bound to pay gratuity.

Hi,
My name is Venkataramana Rao and I am from Hyderabad.
I need information, either I eligible for Gratuity?. I worked in one Medium scale Product based Organization from 26 Sep 2011 to 30 June 2016 and I maintained my PF account for the Respective organization till 30th Oct 2016.
So please suggest me, do I eligible for Gratuity? and let me know the steps if they failed to pay my Gratuity.
