My employer is not releasing me as client is not releasing me even after serving notice period
Hi i am facing a very bad situation. my parent organization is wipro but i am working in client place which is a reputed mnc. i resigned on 24 june in wipro portal. also i sent a mail to my manager. technically my last date supposed to be 20th september. new company joining date was 28th september. as per rules my manager should inform client. but as he was not informing i sent a mail to my hcl manager on 17th august to inform client but he informed on 27nd august 2018. only 23 days before. when client shouted to him and he informed client that they will retain me. but i denied that time. so due to this few days wasted and finally client got confirmation on 2nd september. now client forced me to retain or take release after 1 month that is 2nd october. so i sent a mail to my new company for extension but didn t get any reply within 7 days. so i agreed to stay. now wipro is giving very bad hike and new company sent a mail of extension on 3rd october 2018. so i decided not to retain. after informing that to client now client shouted on me and told me they will not release before 1 month from now which is 14th october 2018. as i have client laptop without getting release from client i won t get release from wipro. also wipro manager is not ready to release me. please tell me what to do and how to manage to leave? any legal way are there as i didn t revoke my resignation. all discussion happened verbally only. there is no written communication about this retention. can client forcefully stop me? what to do with the laptop? suppose i kept the laptop at client office and sent them a mail about my decision and didn t go client office after 20th september will it helpful? relieving letter is mandatory to join new company.
Ex- employer is not releasing my relieving letter and experience letter
Recently i resigned from my previous employer. this is one of the worst company they lacks professionalism and corporate culture. their staffs are also dumb. so i decided to resigned from this company and got another opportunity in next company. now as i said they dont have as such processes i asked them to relieve in 3 days however they have 1 months of notice period. they drop a mail regarding of resignation and my last working day which was 31st aug2016 with. management was ready to relieve me in 3 days. i asked my employer to release my relieving and experience letter on my last day of working as it was mandatory documents for joining other company. here comes the twist till last date of working no one raised any concerns regarding my reliving letter or notice period. now they are refusing to release my reliving letter and experienced saying as you didnt served the notice period of 1 month we cant release the relieving letter and experience letter on such a short notice. however they have already accepted my resignation by mail stating that: we are accepting your resignation. you are relieved on 31aug2016 your relieving letter will be issued by 25th september 2016. now my new joining date was 01sep2016 and now its on hold as my new employer is asking my relieving letter. please help me to handle current scenario. should i ask my exemployer to release my relieving letter by a legal notice? note: in my previous employment contract there was clause to serve notice period of one month except this nothing was mentioned anywhere.
Please read my situation and suggest if i must get release letter
Due to medical problems i was not able to continue my job at a famous it company in chennai. i went to office only on the first day the induction program and could not go to work from the second day ie i did not start working formally. i submitted a bond for two years on the first day. i spoke with my hr and he understood my situation. i emailed him my resignation letter and he accepted the same via email. he told over phone that he would give me waiver for the bond breakage fee as my case was genuine. now is the email correspondence enough for proper relieving from the company? or should i get a release/relieving letter from the company in order to avoid problems in the future? the release letter must be obtained from another branch of the company and i am worried if they would ask for bond breakage fee or would create further problems. my hr advised me that release letter for one day of work will not be helpful. what should i do to avoid background check related problems when i join another company? please help me.
