Dear All,
Our company is in chennai and we have 130 employees. We had a PF inspection in our office and i had provided all the required files and documents which he required. Now the problem is after seeing our salary paper he says and every employee should pay PF for 6500. around 36 employees are getting a basic salary below 6500. The PF officer says that other than HRA we need to consider all the other break up and pay the PF also he said that in the salary breakup around 70% of the amt should be the basic pay. Now i really don't understand what i have to to do. Is there any revised basic pay rule?
Please help me in this regard.

Dear Prema,
Do not worry, first of al you are paying all the employees as per the minimum wage Act only? If yes no need to worry, there is no clause for such claims in P.F. Act. If the employee is earning a basic more than 6500 that only it is restricted upto 6500/- rupess.
Do not worry I think he needs to extract money from you that is why he is twisting you. go ahead with your papers and Be sure that you are paying minimum wage to all of them and paying the p.f contribution as per that.

take a guide from any legal consultant.
sometimes if they want have some special attention from you, then try invent any new problem and place in front of you to either accept it or make him happy.
try to sort out with mutual understanding and take him to dinner at good resturant and ask him solution for the same but also do consider with legal consultant

Thanks a lot for your advise. This PF inspection is seemed to be a strict officer, he is not expecting anything, thts for sure. Now i have to check whether we are paying minimum wages I will check on it.

Actually minimum salary paid is 7000 and not below that, it is autually paid as a stipend and for them also deduct 12% from 7000 (i.e) we pay 840 from both the side . Hope this should not be problem. Kindly advise.

this people act tooo strict in front of us, even i have gone through same situation - came accross a stiff inspector behaving very dedicated and tough but i was surprise to hear his price of rs. 30,000 cash thorugh our legal consultant

Dear all
We are also facing the same problem last two years back. As per advice of the Vigilance officer to pay the balance amount. Below 6500/- is the basic than you can add other allowance also.
Please check with the PF office commissioner to take the Issue
