Dear All,
I am working in a manufacturing firm. Our Firm is under Shops & estabilshment Act , Delhi. Earlier we were granting 24 paid leaves to employees without any categorisation of EL,CL & Sl.
I want to reframe this policy with categorisation of Above three.
My confusion is likewise, suppose I am giving 15 El,8 Casual & 7 Sick leaves to an employee & If he/she takes one or two casual leaves in a month, will he able to get the earned leaves or he will have to present regularly till 20 days.
Pls clarify.

Dear Aanchal Tyagi, Earned leave is applicable for attendance, not for physical presence. All eligible leaves will be treated as attendance. Abbas.P.S

Dear Anchal, 24 leaves can be given as : 12 EL (One each for Month,) 6 SL ,6 CL (0.5 Each for One month) EL will be against the attendance only. Will be given if present. Regards, Manish

Thanks for giving nice suggestion but please let me know what is the rule as per shops & estabilshment & rest the other comment says in this thread that EL is for total attendence not for physical presence.
I am confused still by reading comments.

But whatever you have posted, it is creating confusion because some of the HR professional told me it is as per actual attence or physical presence only.

Hi Anchal,
EL is given for total present days (attendance) in a month.
(In case of Present only, Approved leave and all weekoffs are considered to be present)

Hi all,
I am working in a Pvt. Ltd. as a HR. Here der are only 12 EL and no CL or any type of leave.Now my problem is all employee are asking to increase the number of leave at the same time to prepare the list of holidays (here i have to mention that the holidays is depend on the decision of top Management at the day.)now i am stuck between the top Management and employee.
SOMEONE CAN HELP ME OUT...........
and please share the list of holidays ( 2011 0 for PVT companies.)

In our company I am also faceing same problem. But I have suggested top Management to increase the leaves and add sick leaves,casual leaves, matiranary leaves. Now they are thinking on that & hope they will do that.
So u can also suggest to ur top Management also tell them it is as per Labor Law.

Dear Aanchal and Manish,
1. Please read sec 22 of Delhi Shops and Establishment Act 1954; it refers to leaves!!
2. As per the Act, 15 EL's and a total of 12 CL and SL's are granted.
3. Earned Leaves, Casual Leaves and Sick Leaves; if approved by the organization and availed; makes an employee elegible for leave generation.
4. However, if an employee takes a leave/leaves and he has no leave balance, then this day/days will not qualify for the leave generation.
5. If an employee takes a leave and the leave is not approved by the organization; then the leave days will also not qualify for the leave generation.
